Which is the most interrelated GDPR provision?
LINC (Laboratoire d’Innovation Numérique de la CNIL – Commission Nationale de l’Informatique et des Libertés) created an interactive tool to identify the links between the #GDPR provisions
Had I been asked to name the most interrelated article of the GDPR, I’d have said art. 4 or 6. As shown in the tool, my answer would have been a terrible fail.
The provision that has more connections is article 83 – General conditions for imposing administrative fines.
This begs the question: is the GDPR modelled towards sanctioning? I don’t think so.
The GDPR embraces a risk-based approach to #dataprotection, whereby controllers and processors are required to implement protective measures corresponding to the level of risk of their processing activities.
However, legal provisions must have teeth, i.e. authority to compel obedience or punish offenders. This is the reason why art. 83 emerges as the most linked provision
