The GDPR incorporated a provision directly connected to #AI: the right not to be subject to a decision based on automated processing, including #profiling (art. 22 GDPR).
While this right is not a #gdpr novelty (the French Law on Computers, Files and Freedoms of 6 January 1978 already included a similar provision), it can be said that the regulation has given it a more international scope.
The European Data Protection Board in 2018 issued guidelines to better interpret and apply this provision.
And even though that some uncertainties still remain (e.g. the existence and extent of a right to explanation), the guidelines are an invaluable and easy-to-understand resource for practitioners.
However, as with many EBPD materials, these guidelines are long and require some hours to digest them. To facilitate this task, I’ve prepared a summary of them. Hope you find them useful.
