First company fined for not appointing an EU #representative
Locatefamily.com, apart from processing personal information without a proper legal basis, had not appointed a representative in the EU.
The fine is dissuasive:
– €525,000 for the period from May 25, 2018 to the day the fine was imposed (10/12/2020)
– €20.000 every 2weeks it fails to comply with the order from March 31, 2021. By last week the company had not confirmed to the Autoriteit Persoonsgegevens (Dutch DPA) whether it has appointed a representative in the EU
To my knowledge, this is the first fine imposed on a foreign company for violating art. 27 #gdpr
Enforcing the fine will be another chapter, but it’s good to know that DPAs have started monitoring these provisions
PS: GDPRHub published a letter from the LU DPA where it refused to open an investigation against a company established abroad that has not designated an EU representative
