The Italian Data Protection Authority imposes a €20.000 fine to Gedi SpA for the dissemination on 25 Oct 2019 on La Repubblica (second most-read IT newspaper) of images depicting 2 individuals who were detained in relation to a serious crime that took place in Rome (homicide of Luca Sacchi) and appeared to be taken under physical constraint by police.
Only the handcuffs on the individuals’ wrists were pixelated.
On the same day, the IT DPA ordered a temporary limitation on processing (art. 58(2)(f) GDPR) concerning further publication, including online, of the images unless they remove non-essential details that could harm the dignity of those individuals.
The media group did not answer the order due to an involuntary and accidental internal communication mistake. They removed the images in Feb 2020
The DPA held that where the images contain non-essential details that harm the dignity of the person it is not enough to pixelate the handcuffs if the subject is still identifiable, since #dataprotection must be effective
